Patents versus Easy IP™
Which to use, When, and Why?
[/text_block]
Kary Oberbrunner’s exclusive interview with Katie Rubino, Chair of Life Sciences Practice Group at Caldwell Intellectual Property Law, the fastest growing IP Law Firm in the USA. They discuss patents and Easy IP™ and when it makes sense to use each to protect your intellectual property.

Is your Intellectual Property Protected?
[/text_block]
The Digital Age favors a Creator Economy. This means the most value related to your books, businesses, and brands is your Intellectual Property.
[/text_block]
Since 1975 we’ve experienced a massive shift within the S&P 500* from tangible assets to intangible assets. (More on this shift depicted in the image below.)
[/text_block]
In 2020, 90% of assets in the S&P 500 were intangible assets. This trend is only increasing as time goes on.
*The Standard and Poor’s 500, or simply the S&P 500, is a stock market index tracking the stock performance of 500 large companies listed on exchanges in the United States. It is one of the most commonly followed equity indices.[/text_block]
Patents have their Place
[/text_block]
Patents provide protection and they make sense in certain cases like when you want to take infringers to court, borrow money against your patent portfolio, or increase valuation when you sell your company.* (Sue. Borrow. Sell.)
[/text_block]
But patents are expensive (average $20,000) and take a long time (average 3 years). According to the USPTO patents have a first-time rejection rate of more than 85%. As a result, patents often prove to be costly in terms of time and money.

Easy IP™ is the IP Protection for the New World
[/text_block]
We’re quickly moving into Web3, the “new version of the Internet.” By leveraging blockchain technology and smart contracts we’ve developed a patent-pending proprietary process that protects your Intellectual Property cheaper, faster, easier. (More on Web3 depicted in the image below)
[/text_block]
The Need to Prove “First Use”
[/text_block]
The USPTO has much to say about “First Use” in respect to Intellectual Property.
[/text_block]
According to the USPTO, the applicant must provide documentation of “First Use.”
[/text_block]
Smart Contracts are Superior
[/text_block]
Through our proprietary patent-pending process, Easy IP™ integrates blockchain technology giving your Intellectual Property “global protection.” By creating a “time-stamped” smart contract that can never be tampered with or changed, we establish “First Use” that tracks back to you, the owner.
[/text_block]
Smart contracts are superior because they’re immutable and unchanging. This means bad actors cannot change the “time stamp” (First Use) because it’s permanently captured on the blockchain.
[/text_block]
Smart Contracts are Recognized Worldwide
[/text_block]
Smart contracts are the way of the future. Currently states and countries recognize this technology and favor it because of the many benefits listed below. Experts believe soon all transactions will be done via smart contracts. (Example include: marriage licenses, real estate deeds, vehicle titles, academic diplomas, business agreements, etc.)

Easy IP™ QR Code Example
[/text_block]
Our Easy IP™ patent-pending proprietary process can integrate your Intellectual Property Protection with QR Code Technology.
[/text_block]
If you’re unfamiliar with QR Codes, it’s a two-dimensional version of the barcode, typically made up of black and white pixel patterns. They have found their way into mobile marketing with the widespread adoption of smartphones. “QR” stands for “Quick Response,” which refers to the instant access to the information hidden in the Code.
[/text_block]
Some examples of where this custom QR Code can be placed are on business cards, websites, signage, product placement, or the back cover of books. Each unique QR Code sends people to the creator’s Blockchain Verified IP Certificate and smart contract on the blockchain. This reveals ownership of the Intellectual Property, providing additional layers of verifiability and visibility for the entire world to see via any device.
[/text_block]
People can scan your QR Code with their smartphone. When they open their camera app on their mobile phone and hold it over your code for a few seconds a notification pops up. This notification leads your readers to your Intellectual Property registered on ISBNFT.

Frequently Asked Questions
[/text_block]
- (1) What happens to my past IP, if I stop protecting new IP on the blockchain? Do I still need to continue monthly payments?
If you’re not creating more IP then there is no need to pay monthly payments. The monthly payment is only necessary if you keep protecting new IP. You retain all your IP forever regardless.
- (2) What asset do I actually have, if I should I sell my company?
You own your IP represented in a digital asset, backed up by an immutable smart contract. If you sell your company then you simply TRANSFER the asset from your digital wallet to the new owner’s digital wallet. Note: Experts believe in the near future all assets will have a digital twin and reside within your digital wallet. (See pic below.)
- (3) What if I want to turn my Easy IP™ Intellectual Property into a Patent, Trademark, or Copyright at a later date?
Easy IP™ functions much like a “Pre-Patent” since it provides an immutable “First Use” of the Intellectual Property. This is achieved through our proprietary process through leveraging blockchain technology and smart contracts. As a result, proving “First Use” is simple through your global and verifiable smart contract. By protecting your intellectual property with blockchain technology and smart contracts, we establish a “First to File” event. This “time stamp” cannot be changed and altered.
